Terms and Conditions of the Yad Vashem Online Store

Welcome to the online store (hereinafter: the “Website” or the “Online Store”) of Yad Vashem, the Holocaust Remembrance Authority (hereinafter: “Yad Vashem”). These Terms and Conditions (hereinafter: the “Terms”) regulate the use of the Online Store and the services offered by it.

By using or browsing the Online Store, you agree to be bound by these Terms.. Please read these Terms carefully, as they constitute the legal basis for any discussion regarding the use of the Online Store and its services. Yad Vashem’s Privacy Policy, is incorporated by reference into these Terms and by agreeing to these Terms, you also agree to the collection, use, and sharing of information as described in the Privacy Policy.

1.       General

1.1              The preamble to these Terms is an integral part thereof.

1.2              In these Terms, "User" and/or "Customer" means any person and/or entity that makes use of the functions of the Website, whether directly or indirectly, including purchasing, visiting, browsing and/or any other use, whether via a computer, mobile phone or any other means.

1.3              If the Website, at its sole discretion, decides to act differently from what is stated in these Terms in any specific instance, such action will not constitute a waiver, precedent or  obligation for the Website to act similarly in any other instance.

1.4              Yad Vashem and/or anyone on its behalf shall not be responsible and shall not be liable for any direct, indirect, consequential or special damages, caused to a User and/or to a third party, as a result of use or purchase through the Website, not in accordance with these Terms, including loss of income and/or loss of profits.

1.5              In any case of  contradiction between these Terms and information received from another source, these Terms shall prevail.

1.6              Yad Vashem reserves the right to amend these Terms from time to time at its  sole discretion, without the need to provide a warning and/or advance notice, subject to any law. The last version is the binding version

 

  1. The Right to Purchase Products on the Website

2.1     Users aged 18 and over who have a valid ID card and a valid credit card of one of the Israeli credit card companies and/or users with a valid passport  and a valid credit card issued in the same country where the passport is valid, may purchase products from the Website. Notwithstanding the above, Yad Vashem may prevent a user from purchasing products on the Website in any of the following cases:

(a) If a user has used the Website's services to commit an illegal act, or to enable, facilitate, assist or encourage the commission of such an act;

(b)    If a user has intentionally provided incorrect information;

(c)     If a user has committed an act or omission that harms or is likely to harm Yad Vashem or any third parties.

(d)    If a user violates these Terms or any other agreement with Yad Vashem or anyone on its behalf and/or if fails to pay, unlawfully, for products purchased from Yad Vashem, whether through this website or in any other way.

(e)    If the credit card in the user's possession has been blocked or restricted for use in any way.

 

3.       Purchasing and placing an order on the online store

3.1              The sale of any product is subject to actual inventory and the inclusion of a product on the website does not constitute an obligation by Yad Vashem that the product shall be in stock: Yad Vashem does not undertake to maintain at all times an inventory of all the products appearing on the website.

3.2              For the purpose of ordering products from the Online Store, you are required to enter the following information in the order form: first name, last name, ID number, telephone number/mobile phone, mailing address, e-mail and credit card details (including expiry date).

3.3              It is hereby clarified that you are not obligated by law to provide this information  and its disclosure shall be subject solely to your discretion. However, the disclosure of all the information appearing in the mandatory fields as set forth in clause 3.2 constitutes a condition for the  purchase, and Yad Vashem is entitled not to provide the service in the absence of this information.

3.4              Yad Vashem shall be entitled  to refuse to complete a transaction and/or not to offer a service to a particular user at its sole discretion. Yad Vashem will be entitled to cancel a transaction or sale, in whole or in part, where the User's obligations to Yad Vashem have been breached, including if these Terms have been violated and/or in the absence of approval from the credit card company and/or Yad Vashem has discovered that the customer has entered incorrect information and/or concealed information; and/or due to any error, including a clerical error and/or a communication malfunction and/or any other technical malfunction that prevented the provision of the service and/or in the event of a prevention and/or delay due to force majeure.

3.5              The User undertakes to provide reliable, complete and accurate information.

3.6              The registration recorded in Yad Vashem's computers will constitute prima facie evidence that the actions taken on the website were carried out properly and as recorded.

3.7              If you provide incorrect or partial information at the time of placing your order, we cannot guarantee that the products will reach you. In the event that the products are returned to us due to the provision of incorrect or partial information that you provided or due to non-receipt of the shipment, you will be charged for shipping and handling fees.

3.8              In any event that the credit card company refuses to honor all of your obligations, your purchase will be canceled, the product will not be supplied to you and Yad Vashem will be entitled to charge you a cancellation fee subject to the Consumer Protection Law as detailed below, as well as to deduct the shipping fees if the product has already been shipped to you.

3.9              Payment methods on the Yad Vashem Online Store are by credit card, PayPal, Google Pay and Apple Pay.   

3.10           Yad Vashem shall be entitled at any time to change the products offered on the Website, to extend or shorten the duration of the sale and operation of the Website.

3.11           If, after making a purchase of a product, it turns out that the product is sold out and/or cannot be obtained, Yad Vashem may offer you an alternative product if it wishes to do so and/or cancel the purchase and refund your money.

3.12           A payment that is not made in full and on time, including any payment that was unlawfully canceled, will bear interest and linkage at the maximum rate customary at the time at Bank Leumi Ltd. in relation to shekel credit for irregular withdrawals (hereinafter: the "Default Interest"). This Default Interest rate includes the linkage component. You will also be obligated to pay collection expenses, including legal expenses and attorney's fees, incurred by Yad Vashem when collecting your debt.

 

4.       Prices, offers and deals

4.1              The products on the Website will be sold at the prices published on the Website from time to time. The prices provided on the Website are determined at the sole discretion of Yad Vashem who may change them, offer special deals, and offer coupons to redeem on the Website and discounts.

4.2              The products will be sold until Yad Vashem runs out of stock or the site ceases operations.

4.3              Product sales on the Website are intended for individual customers only and limited to reasonable quantities per customer. Products are not intended for wholesale customers and/or resale (purchase from the Website for resale to a third party). Customers may  purchase multiple products up to the maximum number of items specified  for that sale as set forth on the Website. The purchase of any product is subject to final approval by Yad Vashem and payment of the full price of the applicable products. Yad Vashem will be entitled to deny any transaction whose characteristics (including the frequency and quantity of items) raises the suspicion that it is intended for resale.



5.       Delivery Terms & Shipping Charges

5.1              The products will be delivered to the address specified by the User at the time of placing the order, and in accordance with the countries and destinations to which Yad Vashem delivers.

5.2              Yad Vashem makes deliveries to destinations within Israel as well as to selected countries around the world. A list of available destinations will appear during the ordering process or on a dedicated page on the Website.

5.3              Delivery times are as follows:

For delivery within Israel: 4-8 business days from the date of confirmation of payment in the system.

For overseas delivery: 10-20 business days from the date of confirmation of payment in the system.

In-store pickup is available from Yad Vashem in Jerusalem, subject to prior arrangement.

Business days do not include Fridays, Saturdays, holiday eves and holidays.

5.4              The cost of delivery in Israel is: 35 NIS.

5.5              The cost of delivery to overseas destinations is calculated according to the total weight of the books and products selected by the customer at the time of the order. This cost varies from product to product and will be presented to the customer, prior to completion of the order. Yad Vashem reserves the right to update its overseas delivery fees in accordance with the actual delivery costs and the policies of the delivery companies it uses.

5.6              Yad Vashem is not responsible for delays in delivery resulting from circumstances beyond its control, including postal delays, logistical failures, emergencies, unusual weather, strikes, force majeure, or restrictions in the destination country.

5.7              Delivery times for security-restricted areas may be extended beyond the delivery time stipulated in these Terms. A delay due to such security limitations will not be considered a delay in the delivery of the product. In the event that it is not possible to deliver to the Security-Restricted Areas, Yad Vashem will endeavor to deliver the product to a nearby location after prior coordination with the Customer.

5.8              In the event that it is not possible to deliver the order to the address provided, Yad Vashem shall refund the order amount, less handling fees and shipping expenses, if applicable.

 

6.    Cancellations and Refunds
6.1    According to the Consumer Protection Law, 5741-1981 (hereinafter – the “Law”), the Customer is entitled to cancel the transaction within 14 days from the date of receipt of the product without stating a reason.
6.2    The Customer must notify of cancellation of the transaction by email to the Customer Service of the Yad Vashem Book Sales Department at yadvashem.store@yadvashem.org.il. 
6.3    After receiving the cancellation notice and returning the Product in its original packaging, then, provided the Product has not been used, Yad Vashem will refund the payment amount within 14 days, less the delivery cost charged to the Customer at the time of placing the order.
6.4    If the product returned to Yad Vashem is damaged, has been used or is not in brand new condition, Yad Vashem may reduce the refund amount or not accept the return of the product at all.
6.5    Shipping and handling fees may be charged for the return of the Products in accordance with the law and the policy of Yad Vashem Online Store.
6.6    Notwithstanding any other provision herein, where a Product is returned due to the customer's fault, as determined by Yad Vashem, the customer shall bear all additional costs incurred, including shipping fees and customs clearance fees.
6.7    Any refund will be transferred solely to the credit card with which the purchase was paid, minus shipping charges (if charged) and cancellation fees in accordance with the Law and in accordance with the credit card company's schedules.
6.8    Notwithstanding the aforesaid, and in accordance with the Law, a person with a disability, a senior citizen or an oleh hadash may cancel a transaction, within four months from the date it was made, from the date of receipt of the product or from the date of receipt of the document detailing the transaction, whichever is later, provided that the engagement in the transaction includes a conversation between the Yad Vashem store and the customer as aforesaid (including a conversation by means of electronic communication). The Yad Vashem store will be entitled to request from the aforementioned user a certificate, as specified in the Law, which proves that he is a person with a disability, a senior citizen or oleh hadash, as the case may be.
6.9    A consumer's right to cancel a transaction does not detract from Yad Vashem's right to sue for damages in the event of the return of products whose value has depreciated as a result of a significant deterioration in their condition while in the consumer's possession, including in the case of the return of a product that has been used, whose packaging has been opened or damaged, that has been impaired, spoiled and/or otherwise affected in any way. The customer is also requested, in order to avoid causing damage to the product, to refrain from using the product and to return it without any defect and/or spoilage of any kind.
6.10    The User will inspect the Product immediately upon receipt and notify Yad Vashem if the Product received is defective or substantially different from what appears on the Website or if it was supplied in error and is different from the Product ordered. In each of these cases, the User will be entitled to cancel the transaction without cancellation fees, and to return the Product to Yad Vashem in the manner prescribed above. In such a case, Yad Vashem will refund, within 14 days of receiving the Product,  that  portion of the transaction price paid by the consumer for the product (or part thereof, as the case may be), cancel the charge due to the transaction, provide a copy of the cancellation notice and will not charge the consumer any cancellation fees. Alternatively, the User will be entitled to request the replacement of the product. In the event that the product is replaced at the customer's request, Yad Vashem will send a replacement product to the user, provided that the product is in stock, at Yad Vashem's expense, in the same shipping method that the customer chose to receive the product in the first place in the original order.

 

7.       7.  Data Security & Privacy

7.1              Yad Vashem manages the Website carefully, skillfully, and in a controlled manner, and takes customary precautions in order to maintain, to the extent  possible, the confidentiality of the information provided by the User. The User details entered on the Website are encrypted with SSL technology. Yad Vashem's undertakes not to use the details of the customers registered on the Website, but only for the purposes of operating the Website, and in order to enable the execution of orders.

7.2              Yad Vashem shall bear no liability for any damage, whether direct or indirect, suffered by the User and/or anyone on their behalf in circumstances beyond its control, including cases of force majeure, if information is lost, accessed by an unauthorized or hostile party, or otherwise misused.

7.4              Yad Vashem makes an effort to provide its customers with proper and high-quality service, although it does not guarantee that the service on the Website will not be interrupted, will be provided in an orderly manner and/or without interruptions and/or will be carried out safely and/or without errors and/or will be immune from unauthorized access to the Website's management computers, damages, breakdowns, malfunctions or failures, including malfunctions in the hardware, software or communication lines to the Website.

7.5              The collection and use of your personal data when using the Website is governed by our Privacy Policy. We strongly encourage you to review the Privacy Policy in detail, as it explains the purposes, legal bases, and methods of processing your personal data, as well as your rights in relation to it.

 

8.       Responsibility

8.1              The User hereby declares and confirms that _____ is solely responsible for billing and clearing transactions executed on the Website, and that Cheetah is solely responsible for delivery of the Products to the User.

8.2              The User represents and confirms that they are aware that:

(a) Yad Vashem will not be liable for any damage caused by or as a result of delays in the delivery of the products.

(b) The Service on the Website is provided for use on an "as is" basis. The User shall not have any claim, demand or cause of action against Yad Vashem in connection with the Service on the Website's  features, characteristics, limitations or suitability to the User's needs and requirements.

(c) Yad Vashem makes every effort to maintain the proper operation and continuity of the Website's service. Despite its efforts and since this is an online work environment, Yad Vashem does not guarantee that the service on the Website will not be interrupted, and does not guarantee that it will be provided in an orderly manner without interruptions, breakdowns, malfunctions, including malfunctions in hardware, software or communication lines. Yad Vashem shall not bear any liability, directly or indirectly, for any damage or expense resulting from such interruption.  This includes any case in which the User's  request and/or offer was not accepted (for any reason) and/or any technical problem that prevents the User  from making a purchase on the Website.

(d) Yad Vashem and/or anyone on its behalf shall not be liable and shall not be liable for any direct, indirect, consequential or special damages, caused to the users of the Website and/or to a third party, as a result of use or purchase through the Website, not in accordance with these Terms of Use, including loss of income and/or prevention of profit caused for any reason whatsoever.

8.3              The Website may include links to third party websites, including by means of advertisements, images,  or links, etc. Yad Vashem may, at its sole discretion, remove any link and/or add additional links. Yad Vashem shall not be liable in any way whatsoever for the content and/or services of third parties, the information published by them, or any other detail related to them. Yad Vashem shall not be liable for any direct or indirect damage  monetary or otherwise, which will be caused to the users of the Website as a result of reliance on the information and/or Services provided through such third party links.

 

9.        Intellectual Property

9.1              The copyrights, trademarks and intellectual property on the Store Website, including the contents of the Website, the design of the Website, and any software, application, computer code, graphic file, image, text and any other material included on the Website, are the sole property of Yad Vashem. It is forbidden to copy, photocopy, distribute, publicly display or give any of these to a third party.

9.2              It is forbidden to copy, reproduce, distribute, sell, market, change the design or graphical interface, or to translate any information from the Website (including trademarks, images, texts, sales methods and computer code) without Yad Vashem's prior written permission, and it is forbidden to act in any manner that violates the provisions of any law regarding intellectual property.

9.3              The provisions of this section do not derogate from the provisions of any law, and in addition to them, all the restrictions and prohibitions prescribed by law with respect to intellectual property rights shall apply.

 

10.   Law and Jurisdiction

The exclusive jurisdiction will be vested in the competent court in the Jerusalem District of Israel. Israeli law shall exclusively apply to any dispute regarding the Website and/or these Terms without regard for the rules of conflict of law.

 

11.   Accessibility of the online store

Yad Vashem ensures that the online store is accessible in compliance  with all applicable laws.
